Abstract :  

The modern technology that we enjoy today can be seen as a direct result of the advancements made during  the Second World War. Since then, there has been a significant shift in the way humans live and our reliance  on technology. Artificial Intelligence (AI) has revolutionized various sectors, including healthcare, law  enforcement, social media, and engineering. Today, we live in an era where information about almost anything  and anyone is readily available. However, this accessibility also raises concerns about privacy, as personal  photos and details can be easily accessed and misused. Moreover, conversations can be overheard by  technologies present in our surroundings, leading some individuals to take measures such as covering camera  and microphone areas. Some parents also exercise caution when it comes to posting photos of their children  on social media platforms. 

While AI has contributed significantly to our lives, it also has a darker side. The increasing use of AI has led  to concerns about the erosion of our traditional right to privacy. This paper aims to examine the conflict  between individual privacy rights and the use of AI, particularly in the context of data collection, surveillance,  and decision-making. We will emphasize the need for robust regulatory measures, increased transparency, and  more ethical AI practices to enhance privacy protection. Given that AI has become an integral part of our lives,  it is essential to find a feasible solution that allows privacy and AI to coexist. This paper will analyze the  existing legal framework, including the General Data Protection Regulation (GDPR), and identify regulatory  gaps that have failed to address emerging privacy issues. Ultimately, this paper highlights the importance of  striking a balance between technological innovation and safeguarding fundamental privacy rights.

Introduction :  

Imagine a world where machines can learn, think, and adapt to help us solve complex problems. This is the  world of artificial intelligence (AI), which has been shaped by pioneers like Charles Babbage and Alan Turing. 

AI has already transformed our daily lives, from smart home devices that make our lives easier to online  platforms that connect us with others. But its impact goes far beyond that. AI has opened up new opportunities  for businesses to reach a global audience, improved financial technologies, and even streamlined court  processes. 

However, as AI becomes more powerful, we need to think about how it affects our personal data and privacy.  We want to enjoy the benefits of AI while keeping our information safe. This is a delicate balance, but it’s  crucial for shaping a future where technology serves humanity’s best interests. 

To achieve this balance, we need to develop strong data protection frameworks that ensure transparency,  accountability, and security. We also need to educate people about AI and data privacy so they can make  informed decisions about their data. By working together and prioritizing human-centered AI development,  we can create a future where AI enhances our lives while respecting our individual rights and freedoms. 

It’s a challenge, but it’s one we can overcome with collaboration, dialogue, and a commitment to responsible  AI development.

The Right to Privacy: A Fundamental Human Right1 

The right to privacy is essential for human dignity, autonomy, and freedom. Article 12 of the Universal  Declaration of Human Rights protects individuals from arbitrary interference with their privacy, family, home,  or communications. This right allows individuals to live without unwarranted surveillance and make personal  choices without fear of judgment. 

The right to privacy is closely tied to other human rights, such as freedom of expression and assembly. It  protects vulnerable individuals like human rights defenders and journalists. Privacy also maintains trust in  institutions and promotes social cohesion. When individuals feel their personal information is being misused,  they are less likely to trust institutions. 

Protecting the right to privacy promotes transparency, accountability, and trust in institutions, essential for a  healthy democracy. As technology evolves, protecting privacy is crucial to ensure individuals can live with  dignity and respect. By safeguarding this right, governments can foster a society where individuals feel secure  and confident in their interactions and communications. When it comes to Human Rights, How Significant is the Right to Privacy2

The significance of the right to privacy can be understood from several perspectives: 

1. Protection of Individual Autonomy: The right to privacy empowers individuals to make choices  without unwarranted interference, promoting freedom to form their own identity and act on their  principles. 

2. Promotion of Human Dignity: Privacy maintains one’s sense of worth, safeguards against public  shame, and promotes personal development and introspection.

5. Protection against Arbitrary State Surveillance: The right to privacy prevents governments from  conducting unwanted monitoring, collecting data, or invading people’s privacy.

Studies on the United States highlight its fragmented legal approach, where  sector-specific laws like HIPAA (healthcare) and GLBA (finance) provide limited protection and do not  adequately cover the broader risks posed by AI-driven technologies (Smith, 2021; Johnson, 2022). In contrast,  the European Union’s General Data Protection Regulation (GDPR) is often cited in literature as a more  comprehensive model. It emphasizes user consent, data transparency, and accountability, becoming a global  standard for data protection (Brown & Wilson, 2020). Other countries, such as India (DPDP Act 2023), Brazil  (LGPD), and China (PIPL), have also been discussed in recent research as emerging jurisdictions with growing  regulatory frameworks aimed at balancing privacy rights and technological development (Sharma, 2023; Li,  2022).

Recent literature further explores the ethical risks of AI, especially in relation to surveillance tools such as  facial recognition and predictive policing. These concerns are especially serious in the absence of clear guidelines and accountability  mechanisms.
