National Security at the Age of AI: Mitigating Disinformation Risks with Forward Looking Legal Responses

Abstract

The proliferation of disinformation that is created by AI poses an unprecedented and constantly evolving threat to national security that puts the very foundations of democratic societies at risk, further causing citizens to lose trust in fundamental institutions. In the following research paper, the reasons that “how artificial intelligence is reshaping the magnitude, complexity, and frequency of disinformation campaigns, making the conventional legal and policy frames of responses ineffective”, will be questioned. It assumes that the legislative tools that have been developed to deal with the challenges of the pre-AI era of information are not well-suited to deal with the sophisticated issues that entail synthetic media, hyper-specific messaging and the intractability of attribution. Thus, there will be the need to ensure that each country comes up with pro-active legal reactions which are not only reactive but also proactive, foreseeing future technology and having in place strong measures of transparency, accountability and enforcement. The research aims to submit a comprehensive study of such acute issue to define nature of a threat in it, disclosure key legislative loopholes, suggest the possible legislative and policy solutions as well as explore the complex counterbalance between needs of national security and basic democratic rights.

This has the abilities to corrupt democratic practices, cause social chaos, bend the foreign policy and to mistrust the governments and media houses thus the direct effect is interfered with by this phenomenon directly affecting the stability and security of a given country. The existing law and regulation systems, which have been developed in a time when there was no consideration given to mass adoption of AI, have become quite ineffective to bear these new threats, and thus, a radical change in the understanding of how a society can perceive a legal response to such activities is required. The following paper sets out on the path of detailed analysis of this dangerous impasse, exploring the boundaries of AI-based disinformation as a national security threat and suggesting proactive, prospective legal solutions that can be used to reduce the negative impact of the same and stay true to democratic principles. One of the pillars in this emerging framework of the law should be instituting robust legislative requirements of exposure and disclosure of AI-generated content. This would need to have clear legal responsibility on the part of platforms, content creators, and as well the state actors to have it clearly stated when AI has been employed to generate, or make significant digital media alterations. Such legal measures would perhaps establish standard definitions on what constitutes disinformation proliferated by artificial intelligence, a collective of how various parties can apply it, a framework of how information can be exchanged quickly among countries that have signed up, and even the possibility of adopting common investigations or oversight mechanisms. Such harmonisation of legal responses across the boundaries of individual countries would be useful in sealing any loopholes already used by malicious actors as it would be a more cohesive and stronger front on transnational threats.

In addition to punitive and regulatory actions, the law can and must be the first one to guide the mandatory implementation of public awareness and digital literacy strategies. The governments can introduce policies that would make educational institutions, the television and internet implement widespread programs aimed at providing citizens with the tools to think critically and spot, analyze, and overcome fake stories. It has the drawback that ground-up resilience to disinformation society-wide, the cultivation of a more enlightened and discriminating population, is probably as necessary as mere legal proscriptions. An adaptive and prospective legal approach should be adopted to tackle these significant risks by nations in an effective way. This will be done by going beyond the reactive roles played to introducing proactive structures that are proactive in relation to technology changes. An important part of such strategy should be the requirement of clear transparency and disclosure criteria of the AI-generated content and the possession of the ability to detect synthetic media by the citizens and the investigators. At the same time, the creation of more effective attribution and traceability systems, which may be based on innovative technological solutions, such as blockchain, is essential in order to make the perpetrators responsible, wherever they may be. Disinformation campaigns do not care about national boundaries, which is why joint worldwide efforts of intelligence findings, investigations and enforcement are needed. Furthermore, the introduction of any new law systems should be very carefully elaborated so as to find the balance between national security needs and basic democratic rights, especially free speech. Very broad or vaguely worded interpretation of the regulation can kill the freedom of speech and expression and creativity as well as conversation in the society which ironically may render the democratic ideals that such laws are supposed to uphold. Last but not least, active awareness and digital literacy campaigns remain an absolute necessity, because an aware population will be the very best and first steward against mental manipulation.

In sum, AI requires an active and coordinated legal solution to disinformation that is quick on its feet, technologically savvy, and outwardly democratic. Their governments should ensure that they put in place a detailed system of laws that emphasize on transparency, accountability and global cooperation in countering this growing menace coupled with ensuring that the people are vigilant and self-reliant, and thus, countries can develop effective protection against this emerging menace and retain the integrity of their information space and the stability of their digital societies.
