It discusses how platforms like Twitter, Facebook, and Instagram have become integral to daily life, facilitating real-time communication and the sharing of information. The evolution of social media from its early days, akin to graffiti, to its current diverse forms is examined, emphasizing its function as a digital medium for expression. It analyzes the challenges posed by social media, such as the spread of misinformation and bias, and suggests strategies to mitigate these risks, including public education campaigns and clear guidelines for the use of social media in legal proceedings. Additionally, it stresses the importance of data privacy and security, advocating for measures to protect individuals’ information online This paper also delves into the challenges posed by social media, particularly regarding misinformation and bias. The rapid spread of false information on these platforms can distort public perceptions and compromise the authenticity of legal processes. To address these challenges, the paper suggests implementing public education campaigns to raise awareness about the risks of misinformation. Also talking about the impact of social medias on current events i.e. profound, offering of real-time updates and diverse perspectives on unfolding stories. It has democratized the dissemination of information, allowing individuals to share news, express opinions, and participate in discussions on a global scale. This rapid dissemination of information has led to the viral spread of news, sometimes even before traditional media outlets can report on it.
Talking about the legal arena; Law firms and legal decision-making have been significantly impacted by social media in a number of ways. This tool facilitates rapid access to an extensive database of legal knowledge, supporting legal professionals in their investigation along with choice-making. Additionally, social media platforms facilitate real-time communication and collaboration among legal professionals, clients, and colleagues, enhancing information sharing and resource pooling. Furthermore, these platforms serve as effective tools for networking, enabling legal professionals to expand their professional circles and attract new clients.
Also, if we are talking about the decision-making process how can we forget public opinion and public perception. Social media also plays a role in shaping public perception of legal matters, potentially impacting legal strategies and outcomes. However, its use raises ethical considerations, such as confidentiality and privacy, which must be carefully addressed. Despite these challenges, social media offers valuable opportunities for legal research, marketing, and compliance monitoring, highlighting its significant and evolving role in the legal field.
Despite its many benefits, social media can be criticized for its role in spreading misinformation and promoting polarizing narratives. The echo chambers which are created by social media algorithms can reinforce existing beliefs and contribute to the spread of fake news, making it challenging to discern fact from fiction.
The concept of social media is not new rather it dates back to the time when Graffiti was relevant in the society. Graffiti began to emerge in 20th century. The archaeological discoveries at Pompeii provide examples of writing on an analogue wall—otherwise known as “graffiti” and this gives us evidence with regard to kind to platform that was earlier used as a medium in the society to share their ideas over there similar to that of social media as of now. Graffiti can be defined as the unauthorized visual expression or marking on public or private property, utilizing various mediums such as spray paint, markers, or digital platforms.
The emergence of social media platforms parallels the historical evolution of graffiti as a means of public expression and communication. Just as graffiti artists utilize physical spaces to convey messages, social media users utilize digital platforms to express opinions, share content, and engage in discourse, often without explicit authorization.
Thus, in this very twenty-first century, the introduction of social media has given the idea of the “writing on the wall” a new meaning whereby, social media acts as a digital canvas for people to express themselves, influencing the conversation of the day. People ‘write on the wall’ via posts, tweets, images, and videos on social media sites like Facebook, Instagram, Twitter, and others.

Visual content then came into focus with platforms like Instagram and Snapchat that allows users to share photos and short videos. LinkedIn became the dominant platform for professional networking, while YouTube became the go-to platform for videos. Messaging apps like WhatsApp, Messenger, and WeChat were widely adopted as a more private and immediate way of communication. Twitch, Facebook Live and Instagram Live popularized live streaming, while Reddit and Discord became popular for hosting niche interest-based communities. Ephemeral content became popular with the rise of platforms such as TikTok, with short-form engaging videos. Recently, there has been a focus on audio-based social networking with platforms like Clubhouse and Twitter Spaces. The shifting trends have focused on visual, immediate, and interactive forms of communication, privacy, real-time content. These changes have impacted how people communicate and interact with each other, and the future may hold even more exciting changes.
New research from the Harvard Business Review suggests that consistent interaction and responses to negative feedback on social media may not be as helpful as brands commonly thought. While it’s important to manage negative perception online, these reactions may perpetuate a negative social image. In the realm of legal decision-making, unconstructive criticism is prevalent on social media. Constructive criticism offers a platform for feedback, but it’s crucial to consider its real-world implications. Social media often spreads unverified information, making it increasingly opinion-oriented. Providing constructive criticism requires a delicate approach based on facts, not unverified opinions. It is essential to promote informed, balanced, and constructive criticism that enhances our understanding of the world.
Hashtags and trends in social media categorize content and enhance its discoverability, fostering engagement among users discussing similar topics. In legal decision making, these elements are crucial. They offer real-time insights into public opinion, sentiment, and reactions to legal cases, aiding lawyers and judges in understanding the potential impact of their decisions on the public.
In India, the 2012 Delhi gang rape case, also known as the Nirbhaya case, is a significant example where social media, including hashtags, played a crucial role in legal decision-making. The incident sparked nationwide outrage and led to massive protests both on the streets and online. The hashtag #JusticeForNirbhaya became viral, with people across the country demanding swift justice for the victim. Social media platforms served as a tool for organizing protests, spreading awareness, and putting pressure on the legal system to expedite the trial. The widespread public outcry and the online campaign played a role in influencing the government to introduce stricter laws regarding sexual crimes against women.
Another landmark case in India whereby trendy hashtags played a significant role is the 2018 Kathua rape case. The brutal rape and murder of an eight-year-old girl in Jammu and Kashmir sparked widespread outrage across the country. The hashtag #JusticeForAsifa went viral on social media, with people demanding justice for the victim and calling for harsh punishment for the perpetrators. The case highlighted issues of sexual violence against children and communal tensions in the region. Social media again played a crucial role in mobilizing public opinion and putting pressure on the government and legal system to ensure swift and fair justice. The trial of the accused was closely followed on social media, with updates and developments in the case shared widely.
Also on of the incident known as Dhule lynching case, which occurred in Maharashtra’s Dhule district in 2018. Another notable case in India where social media accusations went viral is the 2018 mob lynching of five individuals in Maharashtra’s Dhule district. The incident was triggered by rumours spread on social media platforms like WhatsApp about a group of “child kidnappers” roaming the area. The rumours led to a mob attacking and lynching five individuals, despite there being no evidence to support the allegations.
In this case, Additional Sessions Judge F.A.M. Khwaja reflects on the dark aspects of modern India, particularly the impact of high-speed internet and social media. He describes how a climate of fear, fueled by rumours can be spread through social media, leading to a devastating incident in a small tribal village in Maharashtra. He emphasized how quickly slander and misinformation can spread on social media, disrupting the lives and mindset of entire communities.

Social media platforms like Twitter, Facebook, and TikTok are of great importance as they are used to mobilize support, raise awareness, and pressure authorities for justice not only this but they also highlight the risks of misinformation and false accusations.
