Abstract

The paper “Human Rights in the Age of Surveillance” examines the complex interplay between the necessity of surveillance for national security and the preservation of fundamental human rights, particularly privacy and dignity. This paper explores the tension between the necessity of surveillance for national security and public safety and its impact on essential human rights such as privacy and dignity. While surveillance technologies like CCTV cameras, dashcams, and voice recorders are critical for preventing terrorism, ensuring public safety, and aiding law enforcement, their pervasive use raises significant human rights concerns. Continuous monitoring can lead to self-censorship, discrimination, erosion of trust in government institutions, and strained professional relationships. Moreover, data breaches and misuse of surveillance data threaten personal security. This paper emphasizes the importance of balancing surveillance with human rights protection through clear legal frameworks, transparency, data protection protocols, and regular reviews to ensure compliance with human rights standards. By adopting these measures, governments can maintain national security and public order while upholding the fundamental rights and freedoms of individuals, fostering trust in governmental institutions and promoting a just and equitable society.

Introduction

Human rights are the basic rights which are available to all human beings irrespective of their caste, creed, sex, color, religion or any other criteria. Humans are granted these rights by birth without any form of discrimination and these rights sustain with them through their life. These rights help human beings to live an easy and dignified life. The basic rights which every human need are rights such as right to privacy, right to dignity, right to life and liberty and many more but these rights are being affected by the surveillance measures which are present in today’s digital era. With the advent of latest technologies, there are many ways by which the activities of a human being can be observed on a daily basis. The governments use the latest technologies to keep a check on the activities of the citizens of its nation. Everything including the people we talk to, the websites we use, the things we buy online are under surveillance measures. In today’s era, some governments even record the voice calls of their citizens to keep a check on them. The governments claim these activities as necessary for the protection of the national security and maintenance of peace in the country but aren’t these the violation of an individual’s human rights. Surveillance is necessary for a nation’s security, protection from terrorism and maintenance of peace but the surveillance measures adopted can create a negative impact on the minds of the people as they violate the human rights which can further lead to the loss of trust of people in government organizations. The excessive and improper use of the surveillance measures can harm the privacy and dignity of a human. There is a dire need to strike a balance between the proper use of surveillance methods for maintain national security and the protection of human rights for helping humans to live a dignified life.

Research methodology

This paper is of descriptive nature and the research is based on secondary sources for the deep analysis of the human rights and their importance, the necessity of the surveillance measures that are practiced and what measures should be adopted for maintaining the balance between the use of surveillance and protection of human rights. Secondary sources of information like newspapers, journals, and websites are used for the research.

Surveillance is critical for the safety and security of nations, playing a significant role in maintaining national security, public safety, and law enforcement. By enabling governments and security agencies to monitor activities and communications, surveillance helps prevent incidents like terrorist attacks and other threats to national security. Surveillance measures are also vital for responding to emergencies and protecting citizens from various threats, ensuring that public safety and national security are upheld.

Surveillance is pivotal for the safety and security of a nation. It plays a major role in maintaining the security, peace, public safety and law in a nation.

Surveillance plays an important role in the maintain the national security as it allows governments and its security agencies to monitor the activities and conversations of individuals that might lead to some incidents like terrorist attacks, which are not good for the security of the nation. Security agencies keep a track of the conversations of the individuals and try to track terrorists and terrorist activities. This helps the nation and its citizens to prevent from being harmed and the security of the country is not breached.

Another important aspect in which the surveillance plays a great role is the investigation and protection of law. The cctv cameras which are used for video surveillance and various other things such as dashcams, voice recorders play an important role in maintaining the law and order of the country as it acts as an important aid in the investigation of crimes. The video and voice recordings can be used as proofs and evidences in an investigation which can ultimately lead the investigating team and help them in finding the real offender.

All these surveillance methods opted by the governments and security agencies are for the maintenance of public safety and national security. The governments use surveillance measure for the protection of its citizens from terrorist attacks, crimes, providing quick helps in emergency situations.

Although the surveillance methods are being used by the governments for the security of its citizens but these measures are affecting the basic rights of the people. The rights of privacy of humans is getting impacted as the security agencies have a track of the location of the individuals and also a track of the calls and records of the individual. The citizens are not free to conversate with any person as they have a fear that some of their confidential information might get leaked. Knowing that you are continuously being observed and monitored can refrain you from expressing your true self and your views and ideas.

There are certain instances of targeted surveillance in which a specific community or society or group of people are being monitored. This can force the people to act in a certain manner and also impacts their right to dignity. The particular community or group can feel discriminated or alienated form the society which in turn effects their dignity and right against equality.

The continuous surveillance not only effects human rights but also evades the trust of people in their governments. The citizens can feel disrespected and this can lead to people losing the trust and faith in the governments. Not only this can be seen at the national level but can also been seen in our daily professional lives. If the employer continuously monitors and tracks us down its employees, then the professional relations start getting affected as the employees feel disrespected by the employer and which ultimately leads to strained relations due to erose of trust from the relationship.

The details we submit on various websites and shopping portals are even not safe as each or other day we get news for data leaks and our personal information gets available in the public domain. These data leaks also impact our human rights in a negative way and sometimes can be dangerous as a person who I having access to our personal information can be a threat to life as well.

The surveillance data can also be misused by the people who are in power and have access to this data. They can further use this data to manipulate and exploit individuals. When the surveillance measures lack proper oversight, it leads to a higher risk of abuse of the human rights. This can also erode the trust of people in public organizations and government and can also make humans feel powerless as it would be difficult for them to challenge this unjust use of surveillance data and their personal information against themselves.

Balancing human rights and surveillance

There is a dire need to balance the protection of human rights and surveillance in today’s era. The protection of human rights is important for the human beings to live a life full of dignity and privacy and maintaining the trust in the government whereas surveillance is required in order to maintain the national security, public safety and law and order of a country. Strict legislations and measure should be introduced for balancing the protection of human rights and surveillance measures to function smoothly.

The governments should introduce legislations which clearly specify the scope, purpose and limit of surveillance. The legislations should clearly clarify the extent up to which surveillance is required and should be carried on. The legislations should specify circumstances under which surveillance is permitted and under which it is not. Provisions for obtaining special permission for surveillance under some specific situations should also be added in the legislation. Also, the legislations should impose strict punishments and penalties for the violations of the rules of surveillance ad any provision of the legislation.

The government should introduce transparency measures and should be transparent about the surveillance systems. The citizens should be aware about what type of surveillance they are under and up to what extent they are being monitored but also, this should be at the discretion of the government as terrorists can use this transparency to escape from surveillance measures. So, the government should look into the matter of transparency and up to what extent it should be applicable.

The protection of privacy of human beings should be the utmost objective. This can be achieved by minimizing the data we provide online and it should be specified as to complete the purpose and irrelevant data should not be collected.  Methods like encryption as we see being used by WhatsApp should be incorporated. This will ensure that even though the data is being collected it will not be infringing the privacy of human beings.

Strict safeguards should be introduced as to who can access the surveillance data. The access of the data should be limited to authorized personnel only and strict protocols should be implemented as to the access and usage of this data. It should also be ensured as to how long the data is being retained and should be made sure that it is deleted after the purpose for which it was collected is satisfied.

The government should also conduct regular reviews of the surveillance laws and practices that are being followed in order to make sure that they are not violating the human rights and the laws of surveillance. The government should keep a check on the data collection and the security agencies as they are not misusing the data of the individuals. The government should make sure that any data which is being collected on their behalf or by the security agencies should not be leaked or used for any other personal purposes.

Further, if we talk about surveillance at international level, provisions can be introduced by treaties focusing on international surveillance standards. It should be kept in mind that these standards should respect the human rights. The co-operation among states at international level can help in introducing best practices and methods for maintain the balance between surveillance and protection of human rights.

Some suggestions that aim to strike a balance between the imperative of surveillance and the preservation of fundamental rights are incorporation of legislations for surveillance, defining scope and limit of surveillance, minimizing the data collection, incorporating international standards for maintaining the balance between use of surveillance and protection of human rights and more public awareness regarding surveillance.
