SOCIAL TRANSFORMATION THROUGH HUMAN RIGHTS AND CRIMINAL LAWS IN INDIA

ABSTRACT

No man is above the law and no man is below it, nor do we ask man’s permission when we ask him to obey it. Obedience to the law is demanded as a right, not asked as a favour1. We are all caught in an inescapable network of mutuality tied with a single thread of destiny whatever affects one directly affects all indirectly2. Social transformation is complicated transformation of a society in India this transformation has been importantly influenced by the three organs of the government which are legislature, executive and judiciary. Social change through human rights is a right base discourse challenges beliefs and practice by promoting empathy and understanding it posters at culture that values dignity equality and justice when human rights become ingrained in societal norms they lead to lasting social change. This cultural Shift creates and environment for human rights are respected and upheld. The relationship between the development system and the human rights system has traditionally been a difficult one. Social change through criminal laws acts as a system of rules which are essential for progress and the legal norms guide behaviour with serves in safeguarding fundamental rights and promoting justice. This paper focuses on the social transformation through Human rights and criminal laws within the Indian context. It will give a Holistic view to the readers.

INTRODUCTION

Concept of social transformation

Law is the social science and grows and develops with the growth and development of society, if you see it is rightly said that if you want to study any society, you have to study the laws enacted by that society. Society is an organisation which obeys the immutable law of progress; and change, is necessary for the wellbeing, and indeed the preservation of the social system. So, in order to keep pace with the society the law must continuously change.

“Change” is what if you didn’t changed with time the time will absolutely change you, here if we think of changing the society then the change should starts from us. But here comes the debate than what actually is transformation, so to make it very clear “Change is usually a response to something and happen gradually, while transformation is a significant shift”3.

Here Comes Two Main Concepts:

  • Law changes Society

As we all know parliament make laws for the society which means that the society should change according to it. Legal norms influence societal behaviour.

  • Society changed Law

Sometimes society changes the law as per their actions and behaviour in context to the rest of the society. Collective efforts drive legal reforms.

The question arises How will you bring social transformation? There are many ways but we focus on two main reasons one is Human rights and second is criminal laws. Human rights as everyone of us knows are the basic Fundamental rights. The Vienna Declaration and Program of Action established “Human rights as universal, indivisible, interdependent, and interrelated”. 4 The challenge is to make these rights a reality for everyone.

Law Deep Rooted In Culture

Nation’s culture resides in the heart and soul of its people”. India is a diverse country, known for its culture. In earlier times there was no law which exists in society it was considered that the “Law is a command of superior authority which is backed by Sanctions”. That time, culture was the supreme law of the society, which is followed by its people. Law and Morals are two different concept, for example, going to the Temple and removing shoes before entering the temple is are moral duty but not a legal duty now question arises what is a duty? In a concise manner “Duty” is an obligation, which means an act you are responsible for doing. Mahatma Gandhi said that Law and culture are seem like one soul. When people find any act to be good and beneficial, adapt and agreeable to their nature and disposition, they use and practice it time to time.

Implementation Of Social Transformation

Implementation is the action that must be followed for the execution of an idea of something to actually happen. Implementation of social transformation is a crucial step which should ensure that it will lead to the development of the Society. Social transformation gives way to positive and negative side of an implementation, for some section of society which want a growth and who are ready for change, for them implementation is positive and for some section of society which don’t want a growth and who themselves are not ready for change, for them implementation is negative.

  • Balancing secularism with religious diversity and implement socialist policies effectively remain on going challenge.

Many Languages and Dialect are spoken in India. India is the Hub of all languages. Language is a common source of communication, it is well said that “Good communication is the bridge between Confusion and Clarity”. Being heard is very a impactful and is a source for all the voices. People rely on language to socialize and convey their opinion to people in groups. It plays a vital role for social transformation.

Socialism And Secularism

Socialism and Secularism are the words of great importance in our lives these words were added by 42nd Amendment act in the year, 1976. The socialist nature suggest that the wealth is generated socially and should be distributed equally and Secular nature suggest that the state has no official religion of its own.

When Mahatma Gandhi came to South Africa, he had to deal with racial discrimination due to his skin colour. Once while traveling on a stagecoach along with Europeans, he was asked to sit near the driver on the floor. Mahatma Gandhi came forward with his refusal as clearly this was a great humiliation for him. Consequently, Gandhi had to suffer beating because of his refusal.

Equality in itself means equal opportunity irrespective of their religion. By promoting economic and equity and religious harmony they contribute to social transformation

It ensures the basic structure of the nation which is designed at that the changing circumstances The social transformation will shares contribution for the upliftment of the society. Equalisation of equals gender equality and local self Government and legal reforms are a social change driven by the constitution.

For every wrong there is a punishment. Wrong can be big or small or civil or criminal depending on its nature. Prisoners are the ones in confinement, earlier there was strict rules for prisoners and they live their lives in horrible manner but now the prisoners are used for the work purpose so, that they can contribute their lives and work for country in being jail.
