ABSTRACT
Concerns about privacy, security, and economic growth have been expressed as a result of the rapid advancement of digital technology and the amount of data. India implemented the Data Localization Act to safeguard people’ private information and foster domestic business growth. This research assesses these regulations’ advantages and disadvantages in terms of India’s economic growth, security, and personal information. The legal framework, including laws and guidelines on personal data protection, is explored in this study using a hybrid method. It highlights significant results from case studies and empirical research as it investigates the effects of data localisation on security, privacy, and economic growth. Economic growth may be facilitated by fostering regional data centers, assisting regional technological firms, and increasing job prospects. On the other hand, it may boost business expenditure, deter foreign investment, impede the growth of digital services, and restrict possible economic advantages. Due to technological constraints, compliance expenses, interoperability problems, and the requirement to adhere to international data standards, implementing data localization is challenging. “Data protection regulations aim to improve the control and protection of personal data by mandating that data be stored and processed within national borders. Critics say such restrictions could limit access to data for multinationals, slow the flow of data across borders and hinder the creation of creative data-driven services”[1]. Security regulations can enhance national security by facilitating increased law enforcement, intelligence gathering and surveillance. But concerns about possible government snooping and data misuse raise issues of privacy violations and civil rights violations. The findings will inform decision makers, business stakeholders and civil society groups as policy debates regarding data localization laws in India are underway. It is important to pursue a holistic strategy that considers global data flows and new technological advances while balancing privacy, security, and economics.
